If you are experiencing bullying and/or harassment in the workplace you do have options.

The first step is to explore any internal options that may be available to you through the employer's policies and procedures.

An employer is required to have in place policies to discourage or prevent bullying and harassment and procedures to deal with complaints.

This requirement extends from State or Federal Workplace Health and Safety Legislation as well as State or Federal Anti Discrimination Legislation.

The Fair Work Act 2009 provides for general protections in the workplace.  You are protected from adverse action taken against you by an employer in the following circumstances:
  • because you have a workplace right

  • when exercising or choosing not to exercise a workplace right

If you have exhausted all options internally you may need to consider a complaint to an external body.

Depending on the nature of your employment the relevant body may be different.  Generally however you may complain to Fair Work Australia or a State Industrial Relations Commission as well as the various State Workplace Health and Safety authorities.

If the bullying and harassment has resulted in you suffering a psychological injury you may be entitled to workers compensation for that injury.
